Dear Sisters and Brothers:
The Department of Transportation (DOT) recently issued guidance following a December 18, 2025, Executive Order from the President directing the Department of Justice to begin the process of rescheduling marijuana under the Controlled Substances Act. The DOT has made it very clear: nothing has changed regarding drug and alcohol testing requirements for safety-sensitive employees. At this time:
- Marijuana remains a Schedule I drug until the rescheduling process is fully completed.
- DOT drug and alcohol testing regulations remain fully in effect.
- Safety-sensitive employees covered by DOT regulations, including aircraft maintenance technicians, pilots, drivers, and other transportation workers, are still prohibited from using marijuana, regardless of state laws or medical/recreational use.
- DOT guidance regarding marijuana, medical marijuana, recreational marijuana, and CBD products has not changed.
- Laboratories, Medical Review Officers, and Substance Abuse Professionals must continue to follow 49 CFR Part 40 with no modifications.
From the standpoint of IAM District 142, drug and alcohol testing has always been, and remains, a safety issue, not a political one. Our members work in safety-sensitive positions where the decisions made on the job directly affect co-workers, passengers, and the traveling public. A drug- and alcohol-free workplace is essential to protecting lives, careers, and the integrity of our industry.
