Earlier this year, District Lodge 142 saw the culmination of a protracted battle over protecting the rights of work we have a contractual right to perform. The case involved CLT Stores work and was discovered by some very diligent CLT Stores members who subsequently engaged their local IAM Stewards in the filing of the instant grievance. The case moved through the process and was ultimately presented in an arbitration before Arbitrator Richard Bloch. The arbitration centered on an investigation that discovered that management had been secretly executing repair orders at remote locations for years. All of these examples were a clear and explicit violation of the Collective Bargaining Agreement Scope provisions. Our case was so strong and the violation was so clear that the company ultimately admitted to the Arbitrator during hearing that they violated the contract. The only thing left to decide at that point was a remedy.
Arbitrator Richard Bloch ultimately awarded the Union in the neighborhood of $50,000.00 based on an analysis that assessed a relative time and value for each violation. In this case, the remedy was never about a monetary award. While it is always nice to receive a financial award in a made whole resolution, the case was always about protecting the work outlined in the CBA. The above award is set to be paid to the CLT IAM Stock Clerk Members on Friday December 13, 2019.
