Dear Flight Attendants:
The following is to clarify a situation which presented itself and to make sure accurate information is out there.
A situation arose 7/21/16 which caused some confusion. The situation was that an ERJ 145 had a maintenance issue and revenue passengers were taken off and the aircraft was to be ferried to IAH. The Captain advised the Flight Attendant to also leave the aircraft and that she would be flying in on next flight from the outstation. Non-revenue passengers then boarded the aircraft and were allowed to be on the ferry flight without the flight attendant. There were 11 non revenue passengers on this particular ferry flight.
If there are less than 19 people on board, it is legal for the plane to fly without a flight attendant. Below is the FAA Rule from CFR 14 91.533 to know for future reference.
§91.533 Flight attendant requirements.
- No person may operate an airplane unless at least the following number of flight attendants are on board the airplane:
(1) For airplanes having more than 19 but less than 51 passengers on board, one flight attendant.
(2) For airplanes having more than 50 but less than 101 passengers on board, two flight attendants.
(3) For airplanes having more than 100 passengers on board, two flight attendants plus one additional flight attendant for each unit (or part of a unit) of 50 passengers above 100.
